AXA S.A., Paris, France, informed us on 22 July 2008 pursuant to paragraph 21, section 1 WpHG that they exceeded the threshold of 5% of the voting rights in TUI AG, Hanover, Germany, on 21 July 2008 and at that point in time held 5.75% (14,456,981 voting shares). All voting shares are attributed to AXA S.A. pursuant to paragraph 22, section 1, sentence 1, no. 6 in connection with sentence 2 WpHG.
