Fidelity International notified us on 2 November 2007 that, as a result of an internal merger reorganisation effective from 1 October 2007, FMR LLC. (a Delaware limited liability company with its principal place of business in Boston, Massachusetts) became the successor entity to FMR Corp. and has assumed all its rights and obligations.
Fidelity International therefore notified us that on 1 October 2007 FMR LLC. held 7.45% of the voting rights (voting rights arising of 3,073,302 shares in K+S Aktiengesellschaft) and therefore exceeded the threshold of 3% and 5%. All of the voting rights of FMR LLC. are attributed to it pursuant to sec. 22 para. 1 sent. 1 no. 6 and sent. 2 of the German Securities Trade Act.
