I. In the name of and on behalf of MBC Investments Corporation, Greenville, USA, The Bank of New York Mellon Corporation, Pittsburgh, USA, notified us pursuant to section 21, paragraph 1, sentence 1 of the WpHG (German Securities Trading Act) that on July 31, 2009 the voting rights of MBC Investments Corporation in K+S Aktiengesellschaft, Kassel, Germany, fell below the threshold of 3% and amounted to 2.90% (4,786,489 voting rights) on this day.
All these holdings of voting rights are attributable to MBC Investments Corporation pursuant to Section 22 paragraph 1 sentence 1 no. 6 WpHG in connection with sentence 2 WpHG.

Further, The Bank of New York Mellon Corporation, Pittsburgh, USA, notified us pursuant to section 21, paragraph 1, sentence 1 of the WpHG (German Securities Trading Act) that on July 31, 2009 the voting rights in K+S Aktiengesellschaft, Kassel, Germany fell below the threshold of 3% and amounted to 2.90% (4,786,529 voting rights) on this day.
These 2.90% (4,786,529 voting rights) are attributable to The Bank of New York Mellon Corporation pursuant to Section 22 paragraph 1 sentence 1 no. 6 WpHG and Section 22 para. 1 sentence 2 WpHG.
