Morgan Stanley, Wilmington, USA, notified us on 17 December 2009 on its own behalf and on behalf of such further subsidiaries as mentioned below pursuant to Section 21 para. 1 and Section 24 German Securities Trading Act that:
1. Morgan Stanley Bank AG, Frankfurt, Germany, on 9 December 2009, has exceeded the thresholds of 3% and 5% of the voting rights of K+S Aktiengesellschaft, and on that day holds 6.90% (13,200,000 shares, each carrying one voting right) of the voting rights; and
2. Morgan Stanley Bank AG, Frankfurt, Germany, has fallen below the thresholds of 5% and 3% on 14 December 2009 and on that day holds 0.04% (76,388 shares) of the voting rights of K+S Aktiengesellschaft, whereby the aforementioned voting rights have to be attributed pursuant to Section 22 para. 1 sent. 1 No. 2 German Securities Trading Act.
3. The holding entity of Morgan Stanley Bank AG, Frankfurt, Germany, Morgan Stanley International Holdings Inc., Wilmington, USA, on 9 December 2009, has exceeded the thresholds of 3% and 5% of the voting rights of K+S Aktiengesellschaft, and on that day holds 7.68% (14,705,208 shares, each carrying one voting right) of the voting rights, whereby the aforementioned voting rights have to be attributed pursuant to Section 22 para. 1 sent. 1 No. 1 German Securities Trading Act from Morgan Stanley Bank AG and certain other subsidiaries; and
4. Morgan Stanley International Holdings Inc., Wilmington, USA, on 14 December 2009 has fallen below the thresholds of 5% and 3% of the voting rights of K+S Aktiengesellschaft, and on that day holds 0.88% (1,684,767 shares, each carrying one voting right) of the voting rights, whereby of these voting rights 0.04% (76,388 shares) have to be attributed pursuant to Section 22 para. 1 sent. 1 No. 2 and sent. 2 and 0.84% (1,608,379 shares) have to be attributed pursuant to Section 22 para. 1 sent. 1 No. 1 of the German Securities Trading Act.
5. The holding entity of Morgan Stanley International Holdings Inc., Morgan Stanley, Wilmington, USA, on 9 December, has also exceeded the thresholds of 3% and 5% of the voting rights of K+S Aktiengesellschaft, and on that day holds 7.78% (14,881,494 shares, each carrying one voting right) the aforementioned voting rights have to be attributed pursuant to Section 22 para. 1 sent.1 No. 1 German Securities Trading Act from Morgan Stanley International Holdings Inc. and Morgan Stanley Bank AG and certain other subsidiaries.
6. Morgan Stanley, Wilmington, USA, on 14 December 2009, has fallen below the tresholds of 5% and 3% of the voting rights of K+S Aktiengesellschaft, and on that day holds 1.10% (2,100,568 shares, each carrying one voting right) of the voting rights, whereby of these voting rights 0.04% (76.388 shares) have to be attributed pursuant to Section 22 para. 1 sent. 1 No. 2 and sent. 2 and 1.06% (2,024,180 shares) have to be attributed pursuant to Section 22 para. 1 sent. 1 No. 1 of the German Securities Trading Act.
