Voting rights notifications pursuant to § 21 WpHG
Details of the notifying parties:
1. The Bank of N.T. Butterfield & Son Limited, Hamilton, HM12, Bermuda 2. Butterfield Trust (Bermuda) Limited, Hamilton HM12, Bermuda; 3. Linetrust PTC Ltd., Hamilton HM12, Bermuda; 4. Linea Ltd., Hamilton HM12, Bermuda; 5. MCC Holding Limited, P.C. 1065 Nicosia, Cyprus
The Bank of N. T. Butterfield & Son Limited made the following notifications regarding the holding of voting rights held in K+S Aktiengesellschaft in their own name as well as for the other aforementioned notifying parties.
The Bank of N. T. Butterfield & Son Limited controls Butterfield Trust (Bermuda) Limited which in turn controls Linetrust PTC Ltd. which in turn controls Linea Ltd. which in turn controls MCC Holding Limited.
1. Notification of voting rights in the name and on behalf of Butterfield Trust (Bermuda) Limited pursuant to § 21 para. 1 in connection with § 22 para. 1 sent. 1 no. 1 WpHG:
On 13 June 2008 Butterfield Trust (Bermuda) Limited exceeded the 10 per cent threshold of § 21 para. 1 WpHG and held at this date 10.43 per cent of the voting rights (i.e. 4,304,127 shares with voting rights) in K+S Aktiengesellschaft. All these voting rights are attributed to Butterfield Trust (Bermuda) Limited pursuant to § 22 para 1 sent. 1 no 1 WpHG. MCC Holding Limited, which is an undertaking indirectly controlled by Butterfield Trust (Bermuda) Limited through Linetrust PTC Ltd. and Linea Ltd., directly holds the aforementioned 10.43 per cent of the voting rights.
2. Notification of voting rights in the name and on behalf of Linetrust PTC Ltd. pursuant to § 21 para. 1 in connection with § 22 para 1 sent. 1 no. 1 WpHG:
On 13 June 2008 Linetrust PTC Ltd. exceeded the 10 per cent threshold of § 21 para. 1 WpHG and held at this date 10.43 per cent of the voting rights (i.e. 4,304,127 shares with voting rights) in K+S Aktiengesellschaft. All these voting rights are attributed to Linetrust PTC Ltd. pursuant to § 22 para 1 sent. 1 no. 1 WpHG. MCC Holding Limited, which is an undertaking indirectly controlled by Linetrust PTC Ltd. through Linea Ltd., directly holds the aforementioned 10.43 per cent of the voting rights.
3. Notification of voting rights in the name and on behalf of Linea Ltd. pursuant to § 21 para. 1 in connection with § 22 para 1 sent. 1 no. 1 WpHG:
On 13 June 2008 Linea Ltd. exceeded the 10 per cent threshold of § 21 para. 1 WpHG and held at this date 10.43 per cent of the voting rights (i.e. 4,304,127 shares with voting rights) in K+S Aktiengesellschaft. All these voting rights are attributed to Linea Ltd. pursuant to § 22 para 1 sent. 1 no. 1 WpHG. MCC Holding Limited, which is an undertaking directly controlled by Linea Ltd. holds the aforementioned 10.43 per cent of the voting rights.
4. Notification of voting rights in the name and on behalf of MCC Holding Limited pursuant to § 21 para. 1 WpHG:
On 13 June 2008 MCC Holding Limited exceeded the 10 per cent threshold of § 21 para. 1 WpHG and held at this date 10.43 per cent of the voting rights (i.e. 4,304,127 shares with voting rights) in K+S Aktiengesellschaft.
5. Notification of voting rights in the name of The Bank of N.T. Butterfield & Son Limited pursuant to § 21 para. 1 in connection with § 22 para 1 sent. 1 no. 1 WpHG:
On 13 June 2008 The Bank of N.T. Butterfield & Son Limited exceeded the 10 per cent threshold of § 21 para. 1 WpHG and held at this date 10.43 per cent of the voting rights (i.e. 4,304,127 shares with voting rights) in K+S Aktiengesellschaft. All these voting rights are attributed to The Bank of N.T. Butterfield & Son Limited pursuant to § 22 para 1 sent. 1 no. 1 WpHG. MCC Holding Limited, which is an undertaking indirectly controlled by The Bank of N.T. Butterfield & Son Limited through Butterfield Trust (Bermuda) Limited, Linetrust PTC Ltd. and Linea Ltd., directly holds the aforementioned 10.43 per cent of the voting rights.
