Horst Plaschna Management GmbH & Co. Beteiligungssanierungs- und -verkaufs KG, Dresden, Germany, has notified us pursuant to Art. 21 I German Securities Trading Act of the following:

"Hereby we notify you pursuant to Art. 21 I German Securities Trading Act, that on 5 January 2009 (day of Adolf Merckle's death) our voting rights went over the thresholds of 3%, 5%, 10%, 15%, 20%, 25%, 30%, 50% and 75% and on that day amounts to 79.18% of the voting rights (98,977,794 voting rights).

Out of these 79.18% of the voting rights (98,977,794 voting rights) are assigned to us pursuant to Art. 22 I S. 1 No. 1 German Securities Trading Act.

The voting rights assigned to us are held by the following companies controlled by us whose votings rights in HeidelbergCement AG amount to 3% or more:

- KL Holding GmbH - Kötitzer Ledertuch- und Wachstuch-Werke Aktiengesellschaft - Spohn Cement GmbH - Pan GmbH - LH Leder Holding GmbH - LH Leder Holding Vermögensverwaltung GmbH - VEM Vermögensverwaltung GmbH
