Susanne Klatten Beteiligungs GmbH (until 22 December 2008 operating under the name of DataCard Three GmbH) with its seat in Bad Homburg v.d. Höhe, Germany, has notified us on a voluntary basis in accordance with § 21 Section 1 Wertpapierhandelsgesetz (Securities Trading Act) that its voting rights in Bayerische Motoren Werke Aktiengesellschaft exceeded the thresholds of 3%, 5% and 10% and amounted (unchanged) to 12.55% (75,562,421 voting rights) on 22 December 2008 (when the company name changed to Susanne Klatten Beteiligungs GmbH) and on 23 December 2008 (the day of its notification).
Of these voting rights 3% or more are attributable to Susanne Klatten Beteiligungs GmbH through Susanne Klatten GmbH & Co. KG für Automobilwerte, Bad Homburg v.d. Höhe, Germany, and Susanne Klatten GmbH, Bad Homburg v.d. Höhe, Germany.
